FireflyAI respects intellectual-property rights. If you believe that content on a FireflyAI-hosted channel infringes your copyright, this page explains how to submit a takedown notice and what happens next.

FireflyAI's intermediary status under Indian law (IT Act 2000, as amended) and safe-harbor provisions under US law (17 U.S.C. § 512 — DMCA) apply when we act expeditiously on valid takedown notices. Our ability to maintain these protections depends on following the procedure below exactly.

How to Submit a Takedown Notice

Your notice must include all of the following to be valid. Incomplete notices will not be acted upon.

  1. Your full legal name and contact information (address, phone number, and email).
  2. A description of the copyrighted work you claim has been infringed (including a link to the original work where possible).
  3. The specific URL(s) of the content on FireflyAI that you claim is infringing.
  4. A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
  5. A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or are authorised to act on behalf of the copyright owner.
  6. Your electronic or physical signature.

What Happens After We Receive a Notice

Counter-Notification (Creator Response)

If your content was removed and you believe the takedown was made in error or you have a licence to use the material, you may submit a counter-notification. Your counter-notification must include:

  1. Your full legal name, address, phone number, and email.
  2. Identification of the specific content that was removed and its URL before removal.
  3. A statement under penalty of perjury that you have a good-faith belief that the content was removed due to mistake or misidentification.
  4. A statement that you consent to the jurisdiction of the courts of India.
  5. Your signature.

If we receive a valid counter-notification, we will forward it to the original complainant. If the complainant does not notify us within 10 business days that they have filed a court action, we may restore the removed content.

Repeat Infringer Policy

In accordance with our Creator Agreement and applicable law, FireflyAI will terminate the accounts of creators who are found to be repeat copyright infringers. A "repeat infringer" is a creator who has received three or more valid, uncontested DMCA takedown notices within any 12-month period, or who has been found by a court to have infringed copyright.

Abuse of the Takedown Process

Filing a knowingly false DMCA notice is a federal crime in the US (17 U.S.C. § 512(f)) and may expose you to civil liability and criminal penalties in India. We report patterns of abusive takedown notices to the relevant authorities.
